Preliminary Provisions

  1. The online store at www.volantor.pl (hereinafter referred to as the “online store”) is operated by its owner – Probiolife Spółka z ograniczoną odpowiedzialnością (hereinafter referred to as “Probiolife Sp. z o.o.”), with its registered office at ul. Słoneczna 32, 55-095 Długołęka, entered into the Register of Entrepreneurs of the National Court Register by the District Court for Wrocław Fabryczna, 9th Commercial Division of the National Court Register under the number 0000305642, with a share capital of PLN 50,000.00, holding NIP 8961515459, REGON 020712601.
  2. These Terms and Conditions define the rules for providing services in the online store.
  3. These Terms and Conditions are based on:
    a. The Civil Code Act of April 23, 1964 (Journal of Laws 1964 No. 16, item 93);
    b. The Act of July 27, 2002, on specific terms of consumer sales and amendments to the Civil Code (Journal of Laws 2002 No. 141, item 1176);
    c. The Act of March 2, 2000, on the protection of certain consumer rights and liability for damage caused by dangerous products (Journal of Laws 2012, item 1225);
    d. The Act of July 18, 2002, on electronic service provision (Journal of Laws 2002 No. 144, item 1204);
    e. The Act of August 29, 1997, on the protection of personal data (Journal of Laws 2002 No. 101, item 926).

Type and Scope of Services Provided

  1. The online store offers products and publications available in the offer of Probiolife Sp. z o.o. via the website www.volantor.pl and email: sklep@volantor.pl.
  2. Information about the services provided, including products and publications, is available on the website www.volantor.pl.

Terms of Electronic Service Provision
Probiolife Sp. z o.o. uses cookies to monitor how the website www.volantor.pl is used. The types of cookies used by Probiolife Sp. z o.o. include session cookies, which function only while browsing the website, enabling its proper functioning, and persistent cookies, which remain on the computer after visiting the website. It is possible to use the website without cookies, but some functions or services of the online store may not work properly. If the customer does not consent to the use of cookies, they should adjust their browser settings to reject or signal cookies at any time, although this will prevent placing orders and logging in, thus blocking access to features visible after logging into the store.

Placing Orders

  1. Placing orders in the online store is possible provided that the IT system used by the customer meets the following minimum technical requirements: a PC or any other device with internet access and a browser correctly supporting HTML 4.01. Additionally, the browser should have JavaScript enabled and cookies support activated.
  2. To make purchases in the online store, an active email account and a customer account are required. A customer account is created by completing the form available at https://volantor.pl, particularly by providing an email address, setting a password for the account, and accepting these Terms and Conditions.

Order Process and Agreement Formation

  1. The process of placing orders, entering into sales agreements, and fulfilling obligations includes the following steps:
    a. Selection of products or publications;
    b. Selection of delivery method and delivery address, as well as the address for issuing an invoice, if applicable;
    c. Selection of payment method;
    d. Placing the order;
    e. Payment and receipt of the ordered products.
  2. Orders can be placed 24/7 throughout the year. Orders placed on Sundays and holidays will be processed in the order they are received on the next business day.
  3. After placing an order, the customer receives an email confirmation of the order submission to the online store, including confirmation of all essential order details.
  4. By placing an order in the online store, the customer makes an offer to Probiolife Sp. z o.o. to enter into a sales agreement for the ordered products or publications. The online store’s confirmation email constitutes an acceptance of this offer.
  5. The customer can modify or cancel their order until it is forwarded for shipping. Changes can be made by contacting the Customer Service Office via email at sklep@volantor.pl or by phone.
  6. The sales agreement is concluded between the customer and Probiolife Sp. z o.o. Essential terms of the agreement are documented and secured through the issuance of a fiscal receipt or VAT invoice, as chosen by the customer when completing the form.

7. All information about products or publications provided on the website www.volantor.pl, including descriptions, technical and usage parameters, and prices, constitutes an invitation to make an offer within the meaning of Article 71 of the Civil Code, under the terms of these Terms and Conditions. This information does not constitute an offer within the meaning of the provisions of the Civil Code.
8. Product and publication photos presented on www.volantor.pl are for illustrative purposes only.

Prices

  1. The price information displayed on www.volantor.pl is binding for the parties to the sales agreement at the time the order is placed by the customer.
  2. All prices for products and publications listed on www.volantor.pl are quoted in Polish zloty (PLN), include VAT, and do not include customs fees or delivery costs.
  3. The online store reserves the right to change product or publication prices. This right does not affect the prices of products and publications in orders placed before the effective date of the price change.

Payment Methods and Order Processing
Customers may choose the following payment methods for their orders:

  1. Cash on delivery – Payment is made in cash upon receipt of the order. Order processing begins once the customer places the order.
  2. Traditional bank transfer – A prepayment of 100% of the order value is made to the account of Probiolife Sp. z o.o., account number 53 1090 2590 0000 0001 3233 5755 at Bank Zachodni WBK SA. Order processing begins once the payment is credited to the account.
  3. Electronic transfer – A prepayment of 100% of the order value is made through online banking or other online payment systems to the payment operator’s account. Order processing begins once Probiolife Sp. z o.o. receives confirmation of the successful transaction from the payment operator.

Delivery Terms

  1. Subject to the provisions of paragraph 2, the customer may choose the following delivery methods:
    a. Courier delivery;
    b. Delivery via Poczta Polska (Polish Post);
    c. Personal pickup at the registered office of Probiolife Sp. z o.o., ul. Słoneczna 32, 55-095 Długołęka. Personal pickup requires the presentation of an identity document and providing the order number.
  2. Certain delivery methods may be excluded for specific products or publications.
  3. The time required to prepare the order for shipment (handover to the carrier) is up to 3 business days from the confirmation of the order submission.
  4. The customer will receive email notifications at the address provided in the order form regarding the acceptance of the order for processing, the handover of the order for shipment, and tracking information.
  5. Orders will be processed provided the ordered products or publications are available in the warehouse of Probiolife Sp. z o.o.
  6. If the ordered products or publications are unavailable in the warehouse or for other reasons making it impossible to process the order, the online store will notify the customer within 3 business days of entering into the agreement. Notification will be sent to the customer’s email address provided in the order form or by phone.
  7. In the case of partial unavailability of ordered products or publications, the customer will be informed of the order status and will decide on further processing. The customer may choose:
    a. Partial processing – the order will be fulfilled only for the available products or publications, and the online store will be released from the obligation to fulfill the unavailable items;
    b. Cancellation of the entire order – the online store will be released from the obligation to fulfill the order.
  8. For orders containing microorganisms, processing may be suspended if the temperature is below +5°C or above +26°C in the shipping or delivery area on the shipment day or the forecasted delivery day.
  9. Delivery costs are added to the total order value. The current delivery cost table is available during the order process when selecting the shipping option.
  10. Probiolife Sp. z o.o. is not responsible for delays in delivery caused by the courier service (e.g., courier, Poczta Polska, InPost, DHL, etc.).

Complaints

  1. If the delivered products or publications are inconsistent with the agreement, the customer has the right to file a complaint with the online store within two years from the delivery date, provided the inconsistency is reported within two months of its detection.
  2. The right to file a complaint regarding food products expires if the customer does not notify Probiolife Sp. z o.o. immediately after detecting the inconsistency and no later than:
    a. Within three days of opening the packaging for packaged products with a best-before or expiration date;
    b. Within three days of purchase or delivery for loose products measured at the point of sale or delivered to the customer’s address.
  3. In all cases, complaints must be submitted no later than the expiration or best-before date of the product.
  1. Complaints can be submitted directly to the Customer Service Office of Probiolife Sp. z o.o. at ul. Słoneczna 32, 55-095 Długołęka, or via email: sklep@volantor.pl.
    5. The customer should return the complained-about product via standard economic shipping to the address: Probiolife Sp. z o.o., ul. Słoneczna 32, 55-095 Długołęka. The online store does not accept any shipments sent on a cash-on-delivery basis.
    6. The returned product should be accompanied by proof of purchase, a description, and an explanation of the reason for the complaint (download the complaint form).
    7. Probiolife Sp. z o.o. will respond to the submitted complaint and inform the customer about the next steps no later than 14 days from receiving the returned product. If the complaint is accepted, the defective product will be repaired or replaced with a fully functional one. If this is not possible (e.g., due to the product being out of stock), Probiolife Sp. z o.o. will refund the customer the equivalent of the product’s price.
    8. Costs associated with returning the complained-about product (via economic shipping) will be reimbursed by Probiolife Sp. z o.o. immediately after a positive resolution of the complaint, as described in §10 of these Terms and Conditions.
    9. Products may come with a warranty provided by the manufacturer or distributor. Detailed warranty terms and duration are included in the warranty card issued by the guarantor. The warranty does not exclude, limit, or suspend the customer’s rights resulting from the product’s non-compliance with the agreement.

Right of Withdrawal

  1. Under the Act of March 2, 2000, on the protection of certain consumer rights and liability for damage caused by dangerous products, a customer who is a consumer under the Civil Code has the right to withdraw from a distance sales agreement without providing any reason by submitting a written statement within 14 days from the delivery date.
  2. If the customer exercises their right of withdrawal, the agreement is considered void, and both parties are released from all obligations. Any provided services are returned in their original state unless any changes were necessary within normal usage limits. The return should take place immediately, but no later than within 14 days. If the customer has made any prepayments, statutory interest will be due from the prepayment date.
  3. The withdrawal statement and the returned product must be sent to Probiolife Sp. z o.o., at ul. Słoneczna 32, 55-095 Długołęka. The customer bears the direct costs of returning the product. The online store does not accept any shipments sent on a cash-on-delivery basis.

Refund Policy

  1. If Probiolife Sp. z o.o. is obligated to refund payments made by the customer, the refund will be processed immediately, but no later than 7 business days from the occurrence of the circumstances requiring the refund.
  2. If the customer paid via electronic transfer, the refund will be made to the bank account used for the payment. For traditional transfers, cash-on-delivery payments, or cases where identifying the payment bank account is impossible due to reasons beyond Probiolife Sp. z o.o.’s control, the refund will be credited to the customer’s online store account (overpayment).
  3. Overpayments in the customer’s account will be refunded to their bank account upon the customer’s request, submitted to the Customer Service Office via email to sklep@volantor.pl or by mail to ul. Słoneczna 32, 55-095 Długołęka. At the customer’s request, the refund can also be processed in cash at Probiolife Sp. z o.o.’s office by prior arrangement with the Customer Service Office. Probiolife Sp. z o.o. does not process refunds via postal services.
  4. Probiolife Sp. z o.o. is not liable for failure to process a refund or delays if the customer, despite being requested via email, does not provide the necessary bank account details or fails to provide all required information for the refund process.

Personal Data of Customers

  1. The administrator of personal data is Probiolife Sp. z o.o.
  2. By placing an order in the online store, the customer consents to the inclusion of their personal data in the database of Probiolife Sp. z o.o. and its processing for the purpose of fulfilling the agreement. Providing personal data is voluntary, but failure to consent to its processing prevents the online store from completing the order. The customer is responsible for providing false personal data.
  3. With the customer’s additional consent, personal data will be processed by Probiolife Sp. z o.o. for marketing purposes.
  4. The customer has the right to access, supplement, update, correct, temporarily or permanently suspend the processing of, or delete their personal data if it is incomplete, outdated, false, collected unlawfully, or no longer necessary for the purposes for which it was collected. The customer also has the right to object to the processing of their personal data for marketing purposes.

Final Provisions

  1. Probiolife Sp. z o.o. is not responsible for errors in order processing or other customer directives resulting from incorrect data provided by the customer.
  2. Probiolife Sp. z o.o. is not responsible for transactions made by unauthorized third parties who gain access to the customer’s account due to the customer’s failure to observe precautions when using their login and password.
  3. Probiolife Sp. z o.o. uses cookies to monitor website usage. Session cookies are active only while browsing the website, ensuring its proper functioning. Persistent cookies remain on the computer after visiting www.volantor.pl. Customers can use the website without cookies, but some functions or services of the online store may not operate correctly. Customers who do not agree to the use of cookies should adjust their browser settings to reject or signal cookies. However, this will prevent placing orders and logging in, thus blocking access to certain features.
  4. Polish law applies to sales agreements concluded in the online store. Agreements are concluded in the Polish language.
  5. By placing an order in the online store, the customer accepts these Terms and Conditions.
  6. Probiolife Sp. z o.o. reserves the right to amend these Terms and Conditions. Any changes will take effect no earlier than 7 days from their publication on www.volantor.pl. Orders placed before the effective date of changes are processed under the terms applicable on the order date.
  7. Matters not regulated in these Terms and Conditions are subject to the provisions of the Civil Code and other applicable laws governing online store operations.
